Special entry and asylum rules during a declared migration crisis

Published: 22.04.2026

Slovenian law provides a special regime for foreigners who do not meet entry conditions or have entered the country unlawfully if Parliament declares a “complex migration crisis.” The regime may allow refusal of entry, return to the border and rejection of an asylum request, subject to specified circumstances such as a risk of inhuman treatment, serious health problems or being an unaccompanied minor.

According to the source, if a “complex migration crisis” is formally declared, the rules may significantly restrict entry and access to international-protection procedures for people entering unlawfully or failing to meet entry conditions. The framework does not change the standard process for tourists, workers, students and other applicants who enter with valid documents and a lawful basis. It is most relevant to asylum seekers and families or minors crossing the border outside the established procedure. People planning a regular relocation through a visa or residence permit should treat this as background information, while those considering Slovenia as an asylum route should pay close attention.
