Slovenia’s Constitutional Court found unconstitutional a provision governing procedures during a declared “complex migration crisis.” The court held that the provision failed to guarantee individual decisions, access to information, interpretation, legal assistance and an effective remedy, creating a risk of prohibited collective expulsion.
The ruling limits the use of a single procedure to deny entry or send foreigners to a neighbouring country without assessing individual circumstances. Its practical importance is greatest for people entering irregularly or seeking international protection, rather than for ordinary residence-permit applicants. According to the source, the legal framework must distinguish between these situations and provide an individualised procedure. People planning a lawful relocation should view this mainly as a change to legal safeguards in exceptional migration scenarios.
