The European Commission issued Germany a formal notice over its requirement that non-EU nationals who already hold a residence permit or long-stay visa from another EU country obtain an additional visa for short-term work assignments in Germany. The Commission considers the requirement potentially inconsistent with EU free-movement rules and an obstacle to cross-border service provision.
According to sources, the additional-visa requirement remains an administrative barrier for non-EU nationals who legally live and work in another EU country and are temporarily posted to Germany. In the prospective, this may lengthen document preparation and delay short-term assignments or service provision in Germany. The issue primarily affects posted workers and companies carrying out cross-border activities within the EU. It is worth monitoring for this group because the procedure could be revised if Germany does not resolve the Commission’s objections.
