Poland clarifies residence rules for workers posted by foreign employers

Published: 02.04.2026

Workers posted to Poland by a foreign employer for more than three months must apply for a temporary residence permit before their current legal stay expires. The procedure requires, among other things, a valid type C work permit, proof of stable income and accommodation; the residence permit may be issued for up to three years.

This is a separate residence route for posted workers whose assignment in Poland lasts more than three months. According to the source, filing before the current legal stay expires allows the worker to remain legally while the application is pending, but the residence permit itself does not remove the need for work authorisation. Applicants must prepare a type C permit, evidence of stable income and accommodation, and Polish translations of the relevant documents. The procedure is especially important for foreign employers and posted employees who need to extend their stay beyond the validity of a visa or residence card.
