India Applies New Removal Powers to a Foreign National, Including an OCI Cardholder

Published: 16.10.2026

Mumbai’s FRRO directed a US citizen and OCI cardholder to leave India after he took part in a public demonstration. The reports explain that the Immigration and Foreigners Act, 2025 allows authorities to restrict a foreign national’s stay and order removal for breaches of the law, visa or OCI conditions, or on the basis of an adverse security report.

The sources demonstrate in practice that an OCI card does not make its holder an Indian citizen and does not exclude immigration restrictions. For foreign nationals, including OCI holders, compliance with stay conditions, travel documents and official orders remains essential because the law provides for removal from India and penalties for certain violations. This is particularly relevant to long-term residents, workers and family members relying on a stable status in India. The event is best read as a practical reminder of the limits of OCI protection, rather than as a general rule change for all cardholders.
