Iceland’s Directorate of Immigration states that applicants for several work-related residence permits may remain in Iceland while their applications are processed only while their stay remains lawful. Applicants may not start working before the permit is granted, and exceeding 90 days in the Schengen Area within the previous 180 days may lead to refusal.
According to the immigration authority, submitting an application does not itself extend lawful stay or authorize employment. This directly affects travel planning, filing dates and proof of legal status, especially for visa-free applicants and those who need a visa. Separate restrictions apply to applicants for residence permits based on labor shortages while their applications are pending. The guidance is important for anyone moving for work because overstaying can jeopardize the application.
